Being a lawyer is one of the most wonderful and fulfilled profession because you have the chance in your hand wherein you can help people acquire justice from some of the cases that they encounter. It is a career that you will have to use your critical mind to weigh some things out and make some conclusions that can help solve a certain court case whether it is a land dispute or divorce, a common case for some country. Thus, lawyers can also make a mistake or wrongdoing which is called legal malpractice.
Legal malpractice can be explained, as a certain lawyer did not do their best wherein he was incapable of doing the duties and responsibility of being a protector of the client that he or she handle or represent. As a sad result it may lead to losing the case.
Legal malpractice could be known as intentional or unintentional. The intentional malpractice can be considered as the lawyer breach the agreement between him and his client, wherein he reveal some sensitive information to the other people, that can affect the case. As you know it can lead into serious matter such as loosing the license or being put to jail.
Aside from that lawyers malpractice can also be describe as the lawyer is not fully prepared for a certain case wherein, he did not acted diligently or the performance is without competence that can be resulted of losing the case. Typically, this can be amounted to property as cash as well.
For those individual or group of people that cannot afford to get their own lawyer. The court will appoint a lawyer that will protect them. The available lawyer that the court can get is a well versed lawyer or perhaps a fresh graduate from the law school. However if the client has noticed or observed that there is malpractice, they can have the chance to sue a case. However, it can be done on a proper period that will be given by the law.
It is also hard to establish a legal malpractice for the reason that if the lawyers do the best such as they are fully prepared the case as best that they can. Aside from that even if they lost or overestimate the case, it only means that they made an error. However, it cannot be used as grounds for legal malpractice for lawyers.
The best thing to do, if you are assuming that your lawyer is doing some legal malpractice is to seek the help of professional and expert in the field of law.
